Documents Required for Registration

For Promoters, to register a project under Telangana RERA, following documents need to be submitted.

  • Authenticated copy of the PAN Card of the promoter.
  • Balance sheet and profit and loss account for the last three assessment years.
  • Annual report, Directors report, and Auditors report of the promoter for the last three financial years.
  • Number of open and covered parking areas in the project.
  • Authenticated copy of legal title deeds showing ownership of the land for the project, along with valid documents proving the title chain.
  • Encumbrance Certificate or Non-Encumbrance Certificate.
  • Details of consent from the landowner, including collaboration agreement, development agreement, joint development agreement, if the promoter is not the landowner.
  • Proof of address and identity of contractors, architects, structural engineers, and others involved in the project development.
  • Drafts of the allotment letter, agreement for sale, and conveyance deed to be signed with buyers.
  • Location details and development plan for the proposed project.

Submitting these documents, along with the registration application and fee, is necessary to register a project under Telangana RERA.

To register as a real estate agent under RERA and establish your credibility as a registered agent, then have these documents handy.

  • A copy of your PAN card for identification purposes.
  • Copy of your Aadhar card as proof of your identity.
  • Recent photograph of yourself.
  • Copies of your income tax returns for the last three financial years to demonstrate your financial history.
  • Self-attested copy of your letterhead with a rubber stamp on it, which includes your business details.
  • Receipt or proof of payment for the registration fee.

Registering Projects in RERA Telangana

Visit the official Telangana RERA website.

On the home page, look for the “Search” option in the menu bar and choose “Real Estate Project Registration” from the dropdown menu.

You will redirect to the Account Login page.

Here, if you already have an account, then continue login by entering credentials.

If not, click on the “New Registration” link to create a new user.

  • On the registration page, select the user type as “promoter” and provide the required details.
  • Click on “create user” to proceed.
  • You will receive a verification email on the provided email address. To complete the registration process, click on the activation link in the email.

Once you login with your account

  • Click on ‘Project Details’ and then select ‘Add Project’ from the left panel. 
  • Fill in the details of your real estate project.
  • Proceed to pay the registration fee through the payment gateway to complete the registration process.

Registering as Real Estate Agent

Visit the official website of RERA Telangana.

Look for the “Search” option in the menu bar on the home screen. 

Select “Real Estate Project Registration” from the dropdown menu.

You’ll be taken to a new page. If you’re new to the website, create an account or login if you already have one.

On the left side of the page, find and click on “Registration Details“.

There you go

Select the Information type, enter mandatory details.

Don’t forget to upload the necessary documents.

Finally, complete the registration process by making the payment for your application.

Checking Registered Projects and Agents

Go to the website and find the “Search Registered Projects and Agents” link in the menu list.

Click on the link, and it will take you to a page where you can search for projects and agents registered under RERA Telangana.

Choose your user type, whether you are searching for a project or an agent.

Enter the required information such as the Project Name, Agent Name, or Registration Number in the respective fields.

Once you have entered the necessary details, click on the “Search” button. The system will fetch the desired result based on your search criteria.

Search for the column titled “View Certificate” which contains the Registration Number.

By clicking on the “View Certificate” link, you can access the registration certificate for the respective project.

Validity and Extension of Registration

The registration of a real estate project under RERA (Real Estate Regulatory Authority) is only valid until the completion date specified by the promoter. 

Imagine a situation where a real estate project is registered under RERA, but sometimes it takes longer to complete than expected. In such cases, there are specific reasons that allow for an extension of the registration period.

1. Force Majeure:If there’s a delay caused by natural disasters like earthquakes or tsunamis, or other unavoidable events, the registration can be extended.

2. Other Valid Reasons: In certain cases, if the promoter provides a reasonable and valid explanation, the regulatory authority may grant an extension of up to one year.

Remember, only these reasons are considered acceptable for extending the registration. Any other reasons won’t be valid. If the project isn’t completed within the specified time, the regulatory authority can cancel the registration.

To request an extension, the promoter needs to submit an application explaining the natural disaster or valid circumstances that caused the delay. They also need to pay a fee set by the regulatory authority. This ensures that extensions are granted only in genuine cases of unavoidable events or valid reasons for the delay.

The main aim of the RERA Act is to prevent significant delays in delivering projects to buyers. That’s why developers must provide a clear timeline for completion when registering their projects.

Revocation of Registration

Is the registration of a project under RERA at risk of being revoked? 

Let’s learn the situations where revocation can occur.

The Authority can decide to revoke the registration if:

  • The promoter fails to fulfill any requirements stated in this Act, the rules, or regulations.
  • The promoter engages in unfair practices or irregularities.
  • The promoter violates any terms or conditions set by the competent authority for approval.
  • A complaint is received or the competent authority recommends it.

Projects Eligible for RERA Approval 

  • Projects that are either larger than 500 square meters or consist of more than 8 units.
  • Projects that involve renovation, repair, or re-development without any re-allotment, marketing, advertising, selling, or new allotment of apartments, plots, or buildings are not covered by RERA.
  • Projects that don’t have a Completion Certificate and started before the commencement of the Act.
  • Each phase of a project is treated as a separate entity and requires a fresh registration.
  • Commercial and residential projects, including plots for development.

Exemption of Projects Under RERA

By the way, do you know there are projects which don’t require registration?

Some projects are exempted from the requirement of RERA registration. These exemptions apply to:

  • Small-scale projects: Projects with a developed area of up to 500 square meters or no more than 8 proposed apartments are exempt from the registration requirement. These are considered smaller projects and do not need to go through the registration process.
  • Completed projects: If the developer has already obtained the Completion Certificate (CC) before the RERA Act came into effect, registration is not required. This applies to projects that are already completed and have the necessary certification in place.
  • Renovation or redevelopment projects: Projects involving property renovation or redevelopment that do not involve the marketing, advertising, selling, or fresh allotment of new plots, apartments, or buildings are also exempt. In such cases, where no new sales or allotments are involved, registration under RERA is not required.

Filing a Complaint under RERA

Step 1: Any person facing rights violations under RERA can file a complaint against the violation. 

Step 2: If the decision on your complaint doesn’t bring satisfaction, take charge and exercise your authority to file an appeal within 60 days. 

Still not satisfied, don’t lose hope. Pass it on! 

Step 3: In case the Appellate Tribunal’s decision doesn’t meet your expectations. You have the option to file a case in the High Court within the next 60 days. 

Remember, it’s your right to take action against RERA violations.
